Terms of Service

Welcome to Kismetify. These Terms of Service (“Terms”) form a binding agreement between you and Kismetify (“Kismetify”, “we”, “us”) and govern your access to and use of the Kismetify website, web app, and related services (collectively, the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Kismetify is a personal-development and productivity app focused on goal-setting and habit-building. It provides tools such as an AI mindset coach, journaling and reflection, goal tracking, daily habit streaks, vision boards, guided breathwork and ambient soundscapes, and a library of original written content. The Service is intended for self-reflection, motivation, and personal growth.

2. Not professional advice

Kismetify is provided for general informational and personal-development purposes only. It is not medical, psychological, financial, legal, or other professional advice, and it is not a substitute for the advice of a qualified professional. We make no guarantee of any specific result or outcome. Reliance on any content within the Service is at your own discretion and risk. If you are experiencing a medical or mental-health emergency, contact your local emergency services.

3. Eligibility & accounts

• You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service.
• You sign in using Google. You are responsible for activity under your account and for keeping your credentials secure.
• You agree to provide accurate information and to notify us of any unauthorized use of your account.

4. Subscriptions, billing & Merchant of Record

Kismetify offers a free tier and a paid subscription (“Pro”). Paid plans are sold and processed by Polar (polar.sh), which acts as our authorized Merchant of Record. Polar handles payment processing, billing, invoices, and applicable sales tax/VAT. Your purchase is also subject to Polar’s terms.

• Subscriptions renew automatically each billing period until cancelled.
• You can cancel at any time; access to Pro features continues until the end of the current paid period.
• Prices may change; we will give reasonable notice of changes before they apply to your next renewal.

Refunds are handled as described in our Refund & Cancellation Policy.

5. Your content

You retain ownership of the content you create in the Service (such as journal entries, goals, and affirmations). You grant us a limited licence to store and process that content solely to operate and provide the Service to you. We do not sell your personal content.

6. Acceptable use

You agree not to:

• use the Service for unlawful purposes or in violation of these Terms;
• attempt to disrupt, reverse-engineer, scrape, or gain unauthorized access to the Service;
• misuse the AI coach to generate harmful, illegal, or abusive content; or
• resell or commercially exploit the Service without our permission.

7. Intellectual property

The Service, including its text, library content, audio, design, and software, is owned by Kismetify or its licensors and is protected by intellectual-property laws. We grant you a personal, non-transferable, non-exclusive licence to use the Service for your own personal, non-commercial use.

8. AI features

The AI coach generates responses using third-party AI models. Output may be inaccurate or incomplete and should not be relied upon as factual, professional, or guaranteed advice. You are responsible for how you use AI-generated suggestions.

9. Disclaimers & limitation of liability

The Service is provided “as is” and “as available” without warranties of any kind, to the fullest extent permitted by law. To the maximum extent permitted by law, Kismetify will not be liable for any indirect, incidental, special, or consequential damages, or for any loss arising from your use of, or inability to use, the Service. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.

10. Termination

You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms or to protect the Service. Sections that by their nature should survive termination will continue to apply.

11. Changes to these Terms

We may update these Terms from time to time. Material changes will be posted on this page with a new “Last updated” date, and where appropriate we will notify you. Your continued use after changes take effect constitutes acceptance.

12. Governing law

These Terms are governed by the laws of the Republic of Korea, without regard to conflict-of-law rules, unless a different mandatory law applies to you as a consumer. (Operator entity and jurisdiction details available on request via the contact below.)
